Welcome to Memento (“the app”, “we”). These Terms of Use (“Terms”) form an agreement between you and the developer/operator of the app regarding your use of the app and related services. By downloading, installing, opening, or using the app, you agree to these Terms. If you do not agree, please stop using the app.

1. Services

Memento is a photo-based “memory review & tidy-up” tool built on the iOS Photos library. Key features may include:

  • Random Recall: randomly selects and shows items from your Photos library.
  • Map Recall: groups memories by location (based on photo location metadata, if available).
  • Review & organization: browse items, sync Favorites status, mark for deletion, and manage a trash flow (some features may require PRO).
  • Settings & subscriptions: view app information, subscribe to PRO, restore purchases, and access these Terms and the Privacy Policy.

We may change, upgrade, or adjust services as long as it does not violate applicable laws.

2. Accounts and personal information

The app currently does not require you to register an account to use it. Rules about how information is handled are described in the Privacy Policy.

3. Permissions

To provide core functionality, the app requires iOS Photos permission. You understand and agree:

  • If you deny or later revoke permission, the app may not be able to provide core photo-based features.
  • You can manage the authorization scope (including Limited Photos Access) in iOS Settings; limited access may reduce feature completeness.

4. Your content and rights

Photos/videos in your iOS Photos library (“User Content”) belong to you or the relevant rights holders. The app only reads/displays/processes User Content on your device within the scope you authorize and does not claim ownership of your User Content.

You represent that you have lawful rights or necessary authorization for your User Content. Any disputes arising from infringing content are your responsibility.

5. Acceptable use

You agree to comply with applicable laws and public order and not to do any of the following (including but not limited to):

  • Reverse engineer, decompile, crack, tamper with, or create derivative works of the app (except as permitted by law).
  • Use the app for illegal activities or infringe others’ lawful rights.
  • Interfere with or disrupt the app’s normal operation or bypass reasonable technical protection measures.

6. Deletion and trash

The app may provide features such as “mark for deletion”, “trash”, or “empty trash”. You understand and agree:

  • Emptying the trash or confirming deletion may delete the corresponding items from your iOS Photos library through system interfaces. Deleted items may not be recoverable depending on iOS Photos and your backups.
  • Please evaluate the risk and back up important content before confirming deletion.

7. Subscriptions (PRO)

The app may offer auto-renewable subscriptions (weekly, yearly, etc. as shown in the app). You understand and agree:

  • Price, billing period, trials, and promotions are determined by the App Store subscription page and in-app displays.
  • Payments are processed by Apple through your App Store account. We do not receive your payment details.
  • Auto-renewal: unless you cancel at least 24 hours before the end of the current period, the subscription renews automatically; renewal charges are typically made within 24 hours prior to the end of the current period.
  • Cancel: manage or cancel in iOS Settings → Apple ID → Subscriptions.
  • Restore purchases: if you change devices or reinstall, you can restore eligible entitlements via “Restore Purchases” (if applicable).

8. Third-party services

To provide certain features, the app may integrate third-party SDKs and/or system services (for example, remote configuration, reverse geocoding, and App Store payments). These services are governed by their own terms and privacy policies. We recommend that you read them carefully.

9. Intellectual property

Except for User Content, the app and its components (including UI, icons, code, text, trademarks, etc.) are owned by us or relevant rights holders. Without authorization, you may not use, copy, distribute, or use them for commercial purposes.

10. Disclaimer and limitation of liability

To the maximum extent permitted by law:

  • The app is provided “as is”. We do not guarantee uninterrupted service, error-free operation, or that it will meet all your needs.
  • We are not liable for service unavailability or data anomalies caused by force majeure, system failures, or third parties (such as the App Store, iOS Photos, or network services), to the extent permitted by law.
  • We are not liable for indirect, incidental, or punitive damages arising from your use or inability to use the app, to the extent permitted by law.

11. Termination

If you violate these Terms or applicable laws, we may restrict, suspend, or terminate your use of the app as appropriate. You may stop using the app at any time and uninstall it.

12. Changes to these Terms

We may update these Terms from time to time. We will present the updated terms in an appropriate place. If you continue using the app after an update, you are deemed to have accepted the updated Terms.

13. Contact us

If you have questions about these Terms, contact us at memento_ai@outlook.com.
